'50/50' Suit: Did Seth Rogen's Movie Steal Its Title From the Music Label?
Finally, some movie suit news that does not involve 'The Hangover Part II.' Based on the Hollywood Reporter, Eastland Group has filed a suit from the filmmakers of '50/50,' declaring the film's title was stolen. EMG states that it's been while using "50/50" and "Phifty-50" title since 2000, which there is a common law trademark on "50/50" (meaning the title is "never formally registered but potentially still acknowledged as intellectual property whether it was adopted continuously"). The label initially sent a request towards the studio in September (the film was launched on Sept. 30) to prevent using '50/50.' Clearly, that did not work. THR also states that EMG is demanding "a lasting injunction against utilisation of the title, the destruction of items where '50-50' is attached, as well as an award of all the film's sales and revenues consequently from the alleged violation." '50/50' has presently made $34 million. So ... which means the complaintant wants all that? Not sure on whether EMG is suing people who make bets on gold coin flicks.
